ASIC Moves to Wind Up Capital Guard
ASIC has applied to wind up Capital Guard AU Pty Ltd after raising serious concerns about its management, the handling of investor funds, and the legitimacy of certain bond investments. The company's financial services licence has already been cancelled, and an independent liquidator has been sought to investigate its affairs and recover assets where possible.
On 14 July 2026, ASIC announced that it had applied to the Supreme Court of New South Wales to wind up Capital Guard AU Pty Ltd.
ASIC is seeking the appointment of an independent liquidator to take control of Capital Guard, investigate its affairs, and preserve and recover assets where possible.
ASIC’s Concerns
ASIC stated that it has serious concerns about Capital Guard’s management, the handling of investor funds, and whether certain bond investments offered to investors existed as represented.
ASIC said its concerns include that:
- Capital Guard may have promoted bond investments that did not exist or were not available as represented;
- investor funds may have been used inconsistently with what investors were told;
- Capital Guard appears to have provided false information to its auditor;
- there has been a breakdown in governance and management; and
- Capital Guard failed to comply with regulatory and reporting obligations.
ASIC has indicated that Capital Guard raised approximately $17.4 million from around 80 investors, and that only a small proportion of those funds remain in known bank accounts and payment platforms.
AFS Licence Cancelled
ASIC previously cancelled Capital Guard’s Australian financial services licence on 29 June 2026.
ASIC stated that the cancellation followed findings of serious misconduct, including the promotion of a fake Macquarie Bank bond, providing false documents to its auditor, and making misleading statements on its website.
