When our client fell victim to a sophisticated scam, they lost significant amounts through a series of transactions from her bank account with the National Australia Bank.
Financial Dispute Legal (FD Legal) took on the case before the Australian Financial Complaints Authority (AFCA), challenging the bank’s handling of the matter. We argued that the bank failed to follow mandatory procedures and did not act on clear warning signs involved in the transactions.
After a thorough investigation and determination process, AFCA found partially in favour of our client. The outcome included:
- $140,000 compensation for financial loss, plus interest
- $5,000 for legal expenses
- $3,000 for non-financial loss (stress and distress)
- Refund of transaction fees
This result was achieved despite the bank’s refusal to accept responsibility. FD Legal helped hold the Bank accountable to protect customers from scams, setting an important precedent for similar cases.
