Were You Incorrectly Classified as a Wholesale or Sophisticated Investor? You could have rights to recover compensation

Have you been advised by your stockbroker to invest as a wholesale or sophisticated investor, even though you did not meet the necessary criteria under the Corporations Act? You may have important legal rights and options.

What Is a Wholesale or Sophisticated Investor?

Under the Corporations Act 2001 (Cth), certain financial products and services can only be offered to individuals who qualify as “wholesale” or “sophisticated” investors. These categories are designed for people with significant investment experience or substantial assets, and they are not afforded the same consumer protections as retail investors.

To be classified as a wholesale or sophisticated investor, you must meet strict requirements—such as having net assets of at least $2.5 million, a gross income of $250,000 or more per annum over the last two financial years or receiving a qualified accountant’s certificate confirming your status.

Why Does This Matter?

Have you been advised by you stockbroker to invest into wholesale or sophisticated investments, but you did not meet the tests under the Corporations Act?

If you were incorrectly classified as a wholesale or sophisticated investor, you may have missed out on important protections, disclosures, and safeguards that apply to retail investors. This could include:

  • Providing a statement of advice
  • Access to detailed product disclosure statements
  • Protections against misleading or deceptive conduct
